Classification Notes

Bras / brassieres of all types and materials — underwired, non-wired, push-up, bralette, t-shirt bra, plunge, balconette, strapless, adhesive, nursing, maternity — are classified under 6212.10. Sports bras (Nike Pro, Lululemon Energy, Sweaty Betty) are 6212.10 regardless of compression level. Note that heading 6212 is unusual in not distinguishing between knit (Chapter 61) and woven (Chapter 62) construction; all body-support undergarments go here. Panties / knickers are NOT 6212.10 — women's briefs of cotton are 6108.21 (knit) or 6208.91 (woven). Girdles, corsets, waist trainers, and shapewear (Spanx, SKIMS shapewear) are 6212.20 (girdles and panty-girdles) or 6212.30 (corselettes). Post-mastectomy prosthetic bras with breast forms may still be 6212.10 or 9021 (orthopaedic) depending on medical-device registration. Bralettes with no support structure that function as crop tops are 6114 (knit) or 6211 (woven) if marketed as outerwear, 6212.10 if marketed as foundation garment. The US 16.9% MFN duty on 6212.10 is markedly higher than EU's 6.5% — a classic lingerie-import tariff disparity. Section 301 stacking for China-origin can exceed 40% total landed duty.
