Classification Notes

Tea classification depends on type and package size. Green tea in packages ≤3 kg is 0902.10; in larger packages 0902.20. Black (fermented) tea in packages ≤3 kg is 0902.30; larger is 0902.40. Flavoured teas (e.g. Earl Grey with bergamot, chai spice blends) remain 0902 if tea is the principal ingredient. Herbal teas (chamomile, peppermint, rooibos) without actual tea leaf content are NOT 0902 — they are classified under 1211 (plants for pharmaceutical, culinary use) or 2106.90. This distinction is important: herbal infusions attract different duty rates and VAT treatment in some EU member states.
