Classification Notes

Whey protein concentrate (WPC) and whey protein isolate (WPI) in bulk industrial form are classified under 3504. However, flavoured whey protein powder put up for retail sale with added carbohydrates, flavourings, or vitamins is more likely to be classified under 2106.10 (protein concentrates) or 2106.90 (other food preparations). Pure unflavoured whey powder used as a food ingredient is sometimes 0404.10 (whey products). The distinction between 3504, 2106, and 0404 is important as they attract different duty rates. The US FDA and EU EFSA also regulate protein supplements; non-compliant products may be refused at the border.
